According to the U.S. Fireworks website, consumer fireworks are legal under Federal law for consumer use. However, there are a few things to be aware of. Certain types of fireworks MUST have local approval. These include:

• Smoke and Punk
• Missiles
• Parachutes
• Sky Flyers
• Display Shells
• Aerial Items
As for those that are ALWAYS legal for use?
• Sparklers
• Fountains
• Novelties
• Crackle and Strobe
• Wheels and Spinners
Honestly, approval or no approval, it is critical to ALWAYS be cautious when handling fireworks and creating your own firework display. The National Fire Protection Association estimates that local fire departments respond to AT LEAST 50,000 fires caused by fireworks each and every year—July being a popular time of year for such fires.
